Taiwan Trademark Fee Update: Additional Official Fees for Excess Services Items in Classes 35-45

  In June, the Taiwan Intellectual Property Office (TIPO) has announced amendments to the Trademark Fee Standards, introducing a revised calculation method for trademark applications covering service classes (Classes 35-45). To optimize cost efficiency, the amendment aims to better reflect examination costs and encourage applicants to designate only those services that are genuinely relevant to their business either presently or in the future.

 

  Key Amendments

  Currently, except for specific retail services in Class 35, there was no limit on the number of services that could be designated within Classes 35-45 without additional official fees.

 

  Under the Revised Framework

  Classes 36-45: Up to 20 services remain covered by the standard filing fee. From the 21st service onward, an additional TWD 200 official fee will apply per additional service.

 

  Class 35: The existing surcharge for specific retail services exceeding 5 items remains unchanged (TWD 500 per additional item). However, all other Class 35 services will now also be subjected to a surcharge of TWD 200 per additional service once the number of designated services exceeds 20.

  Conclusion

  According to recent statistics, more than 40% of the applications have designation of services in Classes 35-45. Furthermore, applications that designate over 20 services represent up to 45% of all applications, the fees collected have not reasonably covered the examination costs. It is hoped that this amendment will help reallocate the public examination resources.

 

  Businesses planning to file trademark applications in Class 35-45 should review their service specifications carefully before filing. It is more recommended to select only those services that require unnecessary official fees while maintain appropriate trademark protection.

 

  Although applications covering more services will experience a greater increase in official fees owing to the amendment, filings for goods (Classes 1-34) are not affected, nor the existing surcharge applicable to specific retail services in Class 35 be changing. Reduction of TWD 300 per class for electronic filings and the additional fee TWD 6,000 per class for accelerated examination remain as are.

 

  The effective date of the amendment remains uncertain. However, Tsai, Lee & Chen will closely monitor the development and provide timely updates.
